GOOD EVENING, MAYOR AND COUNCIL MEMBERS, LET'S OPEN WITH, THE VERSE OF THE DAY COMES FROM SECOND CORINTHIANS ONE, VERSES THREE AND FOUR. ALL PRAISE TO GOD THE FATHER OF OUR LORD JESUS CHRIST. GOD IS OUR MERCIFUL FATHER AND THE SOURCE OF ALL COMFORT. HE COMFORTS US IN ALL OUR TROUBLES SO THAT WE CAN COMFORT OTHERS. WHEN THEY ARE TROUBLED, WE WILL BE ABLE TO GIVE THEM THE SAME COMFORT GOD HAS GIVEN US. GOOD EVENING, MAYOR AND COUNCIL, I JUST WANT TO GO OVER SOME OF THE, PROPOSED UPDATES ON THE WATER CONSERVATION PLAN, AS YOU KNOW, SINCE WE'RE A WHOLESALE CUSTOMERS OF UPPER TRINITY AND CITY OF FORT WORTH, WE BY CONTRACT, WE NEED TO FOLLOW THOSE RULES WITHIN THE CONTRACT. AND SO CURRENTLY, WE'RE AT THREE DAYS PER WEEK, A KIND OF A MODIFIED SCHEDULE FROM WHAT WE'VE, WHAT WE'VE HAD IN THE PAST. SO WHAT WE'RE PROPOSING IS TO, WATER AWARENESS TO GO TO TWO DAYS A WEEK WATERING, PER WHAT THE FORT WORTH AND UPPER TRINITY IS RECOMMENDING. AND WE'RE SEEING THOSE, PEOPLE THAT ARE MAYBE WATERING ON THE WRONG DAYS, SO, YOU KNOW, 11 MILLION GALLONS FROM YEAR TO YEAR WITH THE POPULATION INCREASE, THAT'S QUITE A BIG, YOU KNOW, JUMP IN, WATER CONSERVATION EFFORTS. SO WE'RE WE'RE, YOU KNOW, PROPOSING THAT AND FOR YOU TO, YOU KNOW, THINK ABOUT AND WE'LL COME BACK IN JUNE, WITH THOSE UPDATES IN THE ORDINANCE AND, THEN WE'LL KIND OF GO FROM THERE. HOW ARE WE DOING WITH THE WATER? SMART WATER METER DEPLOYMENTS THAT WILL HELP PEOPLE TRACK THIS STUFF IN REAL TIME? WE ARE ABOUT 65% ON THE COMMERCIAL AND ABOUT 4% DONE ON THE RESIDENTIAL. SO THERE'S A LOT OF A LOT OF, A LOT OF INFRASTRUCTURE THERE NEEDED TO GET THIS WATER SUPPLY IN BY, OUR RESIDENTS, OUR WATER CUSTOMERS, BEING WISE WITH THEIR WATER, IT HELPS US AND HELPS THE SYSTEM NOT BUILD AS FAST, UPPER TRINITY HAS A PROGRAM WHERE YOU CAN HAVE SOMEONE COME OUT TO YOUR HOUSE. I THINK COUNCIL. COUNCIL MEMBER HOLMES HAS HAD THAT DONE, AND THEY CAN HELP YOU FINE TUNE YOUR WATER METER, WE'D EVEN WE CAN PARTNER WITH THAT CONTRACTOR THAT DOES IT FOR UPPER TRINITY. AND ACTUALLY WE THEY DO A CERTAIN AMOUNT PER TOWN, BUT WE CAN PAY AN ADDITIONAL AMOUNT IF THERE'S ENOUGH DEMAND. WE CAN INCREASE THAT AS WELL. AND, WITH THESE, WITH THESE, CELLULAR METERS, YOU CAN HAVE AN APP AND YOU CAN REALLY DRILL DOWN AND FINE TUNE EXACTLY HOW MUCH WATER YOU'RE USING. SO WE PUT THE WE PUT THE INFORMATION IN YOUR HANDS TO CONTROL YOUR WATER USAGE AND HELP US KEEP OUR WATER COSTS DOWN. I'LL GIVE YOU A LITTLE BACK GROUND ON THIS AND WHY YOU ARE SERVING AS THE, TERM NUMBER TWO BOARD RIGHT NOW, COUNCIL ADOPTED AN ORDINANCE BACK LAST SEPTEMBER WHICH CREATED THIS ZONE. IT'S ABOUT 884 ACRES. IT'S PLANNED FOR INDUSTRIAL DEVELOPMENT. NEARLY 10,000,000FTâ– !S OF WAREHOUSE SPACE, THIS IS JUST NORTH OF THE SPEEDWAY IN THE CATHERINE BRANCH AREA. THE TERM OF THIS, ZONE IS TO BE 25 YEARS. AND ESTABLISHED TOWN COUNCIL TO BE THE BOARD OF DIRECTORS. AND ALONG WITH THAT, THERE WAS A PRELIMINARY PROJECT AND FINANCE PLAN. NOW IT'S TIME FOR THE BOARD TO MEET AND APPROVE THE FINAL PROJECT AND FINANCE PLAN, WHICH IS ALMOST EXACTLY WHAT YOU SAW IN THE PRELIMINARY, AGAIN, HERE'S THE ZONE JUST NORTH OF THE SPEEDWAY. SO IN THIS FINAL PLAN, IT SETS THAT TAX INCREMENT, WHICH WILL BE OF ADDED VALUE, WHICH WILL BE DEDICATED TO PROJECTS IN THE ZONE AT 50, WHICH ALIGNS WITH THE PRELIMINARY PLAN. AND WHAT WAS APPROVED IN WAS, CONTEMPLATED IN THE DEVELOPER AGREEMENT. WITH THE 25 YEAR TERM, THIS WILL GENERATE ABOUT $27 MILLION OF REVENUES FOR THE ZONE, AND THAT WILL BE UTILIZED TO PAY FOR PROJECTS THAT ARE EXACTLY THE SAME AS WE'RE IN THE PRELIMINARY PLAN. THERE'S ADMINISTRATIVE COSTS THAT WERE COVERED, BUT THE BIG COST IS REIMBURSEMENT FOR CERTAIN DEVELOPER CONSTRUCTED PUBLIC INFRASTRUCTURE. SO ALL OF THIS PROPERTY WILL BE PRIVATELY DEVELOPED, BUT A LOT OF PUBLIC INFRASTRUCTURE WILL BE NEEDED TO MAKE THAT HAPPEN. AND A LOT OF THIS IS STUFF THAT'S ON OUR MASTER PLAN AND WILL BENEFIT PROPERTY OUTSIDE OF THE ZONE, AS WELL AS INSIDE THE ZONE. SO THERE ARE CERTAIN PROJECTS THAT ARE LISTED INCLUDE SEVERAL WATER, SEWER AND ROAD IMPROVEMENTS. THE ESTIMATED COST OF THOSE IS 44 MILLION. AT THIS POINT, SO A LITTLE BIT HIGHER THAN IT WAS BACK IN SEPTEMBER. WE'VE REFINED THOSE NUMBERS AND INFLATION. SO THOSE REIMBURSEMENTS WILL BE CAPPED AT THE ACTUAL VALUE PLUS FINANCING OF THE CONSTRUCTION COST. AND OF COURSE, THERE'LL BE A CAP OF WHATEVER OUR THE REVENUES ARE THAT ARE GENERATED BY THE TERM'S THERE'S NO OBLIGATION TO PAY PAY MORE. IT'S A LONG RANGE PLAN TO IDENTIFY THE LOCATION AND TYPE OF ROADWAY FACILITIES THAT WILL ULTIMATELY BE BE NEEDED. IT'S BASED OFF OF THE COMPREHENSIVE PLAN AND THE FUTURE DEVELOPMENT MAP, WITH THAT, OUR CURRENT THOROUGHFARE PLAN WAS UPDATED, LAST UPDATED, AND ADOPTED ON JANUARY 27TH OF 2022. ONE OF THOSE WAS THE POTENTIAL CONNECTION OF, COMMERCIAL DEVELOPMENT WITH, RESIDENTIAL DEVELOPMENT AND THE MIXING OF COMMERCIAL TRAFFIC AND RESIDENTIAL NEIGHBORHOOD TRAFFIC. STAFF PRESENTED A SIMILAR SITUATION, POTENTIAL SITUATION AND CONCERN SOUTH OF 1171, NORTH WEST OF THE, NORTHEAST OF THE NORTHWEST REGIONAL AIRPORT. AND, AFTER THAT BRIEFING, COUNCIL DIRECTED STAFF TO BRING BACK, THIS AMENDMENT TO ADDRESS THOSE CONCERNS. AND IT'LL BE EASIER INSTEAD OF DISCUSSING THESE JUST TO SHOW IT, THIS IS THE CURRENT THOROUGHFARE PLAN, NORTHEAST OF 407 AND FORT ROAD, THE CONCERN HERE WAS CARPENTER ROAD AND HOW SOME, COMMERCIAL DEVELOPMENT AROUND IT, IT WAS GOING TO CONNECT TO EXISTING PART OF CARPENTER AND CREEK MEADOWS. SO IT BRINGS IT BACK IN TO TIE IN WITH CLEVELAND GIBBS AND KIND OF HELP SEPARATE OUT SOME OF THE COMMERCIAL INDUSTRIAL TRAFFIC, THAT IS ULTIMATELY PLANNED AROUND THE AIRPORT AREA FROM WHAT COULD BE RESIDENTIAL AND SOME RETAIL. ON 1171. AND THAT ONE WAS PRIMARILY DONE TO CONCENTRATE THE TRUCKS TO A SINGLE INTERSECTION. YES. SO THAT WE DIDN'T HAVE MULTIPLE TRUCK CROSSINGS. YES. AND GET THEM THROUGH A SAFE LIGHTED INTERSECTION, ANOTHER ISSUE IN THIS AREA WITH THE PREVIOUS OR THE CURRENT PLANNED ALIGNMENTS.

SO THE STATE LEGISLATURE IS CONSTANTLY CHANGING THINGS UP ON US, AND, WE BRIEFED, COUNCIL ON SOME OF THAT LEGISLATION. ONE OF THOSE WAS HOUSE BILL 3699. AND, IT HAS TO DO WITH, THE PROCESS FOR APPROVAL OF PLATS AND WHO CAN APPROVE THEM. SO WE DID A MORE DETAILED BRIEFING TO THE PLANNING AND ZONING COMMISSION IN, BACK IN OCTOBER. AND JUST IN SUMMARY, THIS HB 3699 IS RELATED TO, MUNICIPAL REGULATION OF SUBDIVISIONS AND APPROVAL OF SUBDIVISION PLATS. IT'S BASICALLY AN UPDATE OF THE 30 DAY SHOT CLOCK REGULATIONS THAT, REQUIRE ACTION ON PLATS WITHIN 30 DAYS. YES, IT WAS, I THINK IT WAS A GOOD CLEAN UP, FOR THE MOST PART. AND ONE OF THE THINGS THAT IT DID ADD IT WAS A SIGNIFICANT CHANGE THAT ADDED THE ABILITY TO DELEGATE ADMINISTRATIVE APPROVAL, AUTHORITY OF PLATS TO STAFF, TO ALL TYPES OF PLATS. PREVIOUSLY, IT WAS VERY LIMITED. WHAT COULD BE STAFF APPROVED. AND, STATE LAW SAID IT HAD TO BE APPROVED BY EITHER COUNCIL OR THE PLANNING COMMISSION IF YOU HAD ONE. AND AS YOU'RE AWARE, TOWN COUNCIL BEFORE THERE WAS A PLANNING COMMISSION, PLANNING AND ZONING COMMISSION WAS THE FINAL AUTHORITY IN APPROVING MOST, PLATS. AND NOW THAT WE HAVE PLANNING AND ZONING COMMISSION THAT WAS DELEGATED TO THEM. SO IN THAT BRIEFING, STAFF PRESENTED SOME OPTIONS FOR CONSIDERATION AND POTENTIAL UDC AMENDMENT. AND THEN THE THIRD WAS, A HYBRID APPROACH, MAYBE YOU COULD, STAFF COULD APPROVE SOME, SOME PLATS AND THEN OTHERS COULD, GO ON TO PLANNING AND ZONING COMMISSION. FIRST IS DIGITAL BILLBOARDS AND THIS CHANGE IN PARTICULAR HAS TO DO WITH THE DEVELOPMENT AGREEMENT THAT WAS AUTHORIZED BY COUNCIL, FOR A LOCATION AT THE NORTHEAST CORNER OF 114 AND CLEVELAND GIBBS ROAD, THAT AGREEMENT CALLED FOR ANNEXATION OF THE PROPERTY, WHICH IS CURRENTLY IN OUR ETJ, AND TO ALLOW FOR A DIGITAL BILLBOARD ON THE SITE AND, TEXDOT REQUIRES TO ALLOW A, ANY DIGITAL BILLBOARDS HAVE TO BE PERMITTED THROUGH TEXDOT IN ADDITION TO THE TOWN AND TEXADOR REQUIRES TO ISSUE A PERMIT THAT IT BE ALLOWED BY THE TOWN AND NOT BE APPROVED THROUGH A VARIANCE OR A MERITORIOUS EXCEPTION. SO THAT'S HOW WE'VE APPROVED THESE IN THE PAST, SO THAT IS WHY THIS IS HAVING TO COME BEFORE YOU. SO THIS AMENDMENT IS LIMITED TO LOCATIONS AT THE ENTRIES INTO THE TOWN, A MAJOR HIGHWAYS. IT KIND OF COVERS OUR EXISTING BILLBOARDS. AND IT ALLOWS FOR THIS ONE BILLBOARD. IT'S BEEN DESIGNED TO NOT ALLOW ANY OTHERS THE WAY, BY THE WAY IT IS WRITTEN. NOW, THE OTHER ASPECT OF THIS AMENDMENT, IT HAS TO DO WITH WINDOWS SIGN REGULATIONS.AND YOU GOT PRETTY FAMILIAR WITH THESE, A FEW MEETINGS BACK AND THE PLANNING AND ZONING COMMISSION'S EVEN GOTTEN MORE FAMILIAR WITH THEM. WE'VE HAD SEVERAL BRIEFINGS DISCUSSING THESE, INITIALLY AFTER A COUPLE BRIEFINGS, THEY AND PROVIDING SOME EXAMPLES FROM, OTHER CITIES, THEY PROVIDED DIRECTION THAT THEY WANTED TO KIND OF ALIGN THE STANDARDS WITH EXAMPLES FROM SOUTHLAKE AND ROANOKE, WHICH HAD SOME SIMILAR REGULATIONS. SO AN AMENDMENT WAS DRAFTED, ACCORDING TO THAT, THAT WAS CONSIDERED AT THEIR APRIL 16TH MEETING. AND, THERE WAS SOME GOOD DISCUSSION THERE ABOUT WHETHER WE REALLY NEEDED THAT SIGNIFICANT OF CHANGES. SO KIND OF HAD MORE DISCUSSION. AND THEY FOCUSED THE COMMENTS ON, LET'S JUST UPDATE WHAT WE HAVE. WE THINK IT WORKS. IT JUST NEEDED SOME TWEAKS AND JUST WANTED IT TO BE MORE CLEAR AND

AND THEN IT SETS A MAXIMUM NUMBER OF SIGNS PER WINDOW, WHICH IS A STANDARD THAT MATCHES THAT, SOUTHLAKE AND ROANOKE ORDINANCE. SO, LIKE I SAID, PLANNING AND ZONING COMMISSION, FINALLY ACTED ON THIS ON MAY 21ST. THEY HELD A PUBLIC HEARING. THERE ARE NO SPEAKERS, AND THEY RECOMMENDED APPROVAL AS IT'S DRAFTED HERE UNANIMOUSLY.
